CPA Members have the exclusive right to use the CPA Model Conditions for the Hiring of Plant, which are under copyright ©.

 

Model Conditions 2011

The CPA has updated the Model Conditions to reflect the changes in legislation and industry practice, which have arisen since the Model Conditions were last revised in 2001.

The 2011 Model Conditions will take effect on the 1st July 2011.

Members are reminded that the 2011 Model Conditions cannot be used for any new hire agreements where Plant and Equipment will be supplied before the 1st July.

Members should use the 2011 Model Conditions; and a note will need to be circulated to all staff reminding them that the Model Conditions will be changing on the 1st July; and that any old copies of the Model Conditions (2001) held on file should be deleted or destroyed.

The Supply of Personnel Only under the Model Conditions 

Members are on occasions approached by customers to supply only personnel without any accompanying plant to fill a specific function on site.

Hire Contract Terms for Consumers

CPA Members have the exclusive right to use the CPA Consumer Conditions.

There are two separate sets of conditions, one for plant supplied without an operator and another for plant supplied with an operator.

Both sets must only be used when dealing with consumers. In general terms, a consumer is someone hiring for private or domestic purposes.

Contract Lifting Services Conditions

Commonly known as Contract Lift Conditions, Members have the exclusive right to use these conditions.

Contract Lift Conditions are to be used when the crane hire company contracts to carry out a specific managed lift, where the Crane Hire company plans and supervises the lifting operation.

For the simple hiring of a crane to work to the customer's instructions, Model Conditions for the Hiring of Plant (2001) should be used.

Supplementary Conditions

The Model Conditions is a set of generic conditions which covers all types of Plant and Equipment. The Supplementary Conditions have been devised for specific groups of plant suppliers who hire out specialist plant and equipment.

These Supplementary conditions, must be read in conjunction with the Model Conditions, and aim to expand on, where needed, the Model Conditions.

Supplementary Conditions are not available for all types of Plant.

Plant Owner Clarification

Members are on occasions classed as a sub-contractor by a customer rather than as a plant-hire provider.
